Terms of Service

1. About these terms

These Terms of Service ("Terms") are a binding agreement between you (the "Customer", "you") and AUTOZAP, a sole proprietorship registered in India (Udyam Registration No. UDYAM-MH-26-1233974), with its registered place of business at Hadapsar, Pune, Maharashtra 411028, India ("Autozap", "we", "us").

By accessing the website at autozap.in, creating an account, or using the platform, you accept these Terms. If you are agreeing on behalf of a company, you confirm you have authority to bind it.

2. The service

Autozap provides a software-as-a-service platform for AI voice calling and customer communication. Depending on your plan, this may include inbound and outbound AI voice agents, call transcription and reporting, appointment booking, WhatsApp Business messaging, CRM and lead management, automated follow-up, and payment collection.

The platform also includes the AI Business Employee, which, once you connect your Google account, can publish posts to your Google Business Profile and your Blogger blog and read your Search Console performance data, as described in our Privacy Policy.

We may add, change or remove features. If a change materially reduces the functionality of your plan, we will give you reasonable notice.

3. Your account

• You must provide accurate registration information and keep it up to date.
• You are responsible for keeping your login credentials confidential and for all activity under your account.
• Report any suspected unauthorised access to us immediately.
• You must be at least 18 years old and legally able to enter a contract.

4. Subscriptions, fees and taxes

• Subscriptions are billed in advance, monthly, quarterly or annually, according to your plan.
• Your payment details must be valid and current. We may suspend or terminate an account for non-payment.
• Unless stated otherwise, fees are exclusive of applicable taxes, which will be added at the prevailing rate.
• We may revise pricing. Existing subscribers will be given at least 30 days' notice before a price change takes effect at their next renewal.
• Refunds are governed by our Refund & Cancellation.

4.1 Third-party charges

Some services carry charges levied by third parties rather than by Autozap. In particular, Meta charges for WhatsApp conversations directly to the payment method on your own WhatsApp Business Account. Autozap does not resell, mark up or collect those charges, and is not responsible for changes Meta makes to its pricing.

5. Licence and restrictions

Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the platform for your own business purposes during your subscription term.

You may not:

• Resell, sublicense, rent or share access to the platform without our written agreement.
• Copy, modify, decompile or reverse-engineer the platform or any part of it.
• Circumvent usage limits, rate limits or security controls.
• Use the platform to build a competing product.
• Use automated means to scrape or extract data beyond the features we provide.

6. Acceptable use

You agree not to use the platform to:

• Send unsolicited bulk messages, spam, or messages to people who have not opted in or who have asked not to be contacted.
• Send content that is unlawful, fraudulent, deceptive, defamatory, obscene, harassing, or that infringes anyone's intellectual property or privacy rights.
• Impersonate another person or business, or misrepresent who is sending a message.
• Distribute malware or attempt to gain unauthorised access to any system.
• Breach any applicable law, including data protection, consumer protection, advertising and telecommunications law.

6.1 WhatsApp-specific obligations

If you use Autozap to connect a WhatsApp Business Account:

• You must comply with the WhatsApp Business Messaging Policy, the WhatsApp Commerce Policy and Meta's applicable terms, as amended from time to time.
• You must obtain and be able to evidence valid opt-in consent before messaging a recipient, and must honour opt-out requests promptly.
• Your WhatsApp Business Account and phone number remain registered to your business. You are responsible for the messages sent from it.
• Meta may restrict, suspend or ban a WhatsApp Business Account for policy violations. Autozap has no control over those decisions and is not liable for them.
• We may suspend your access to WhatsApp features if we reasonably believe your use puts our platform or our standing with Meta at risk.

6.2 Google-specific obligations

If you use Autozap to connect a Google account:

• You may connect only accounts, Business Profile locations, blogs and sites that you own or are authorised to manage.
• You must comply with Google's terms and policies that apply to those services, including the Google Business Profile policies.
• You are responsible for the content published to those services on your behalf, and for reviewing it before you approve it.
• You can withdraw our access at any time in your Google Account permissions. Google may also restrict or revoke access, and Autozap is not liable for those decisions.

7. Your content and data

You retain all rights in the content and data you put into or generate on the platform ("Customer Data"), including contacts, call recordings, call transcripts and campaign records. You grant us a limited licence to host, process, transmit and display Customer Data solely to provide the service to you, to comply with law, and to maintain and secure the platform.

You are responsible for ensuring you have the right to upload and process Customer Data, including a lawful basis for processing any personal data it contains. Our handling of personal data is described in our Privacy Policy.

We do not use your Customer Data to train machine learning models or for advertising.

8. AI-generated output

The platform uses artificial intelligence to generate message drafts, replies and other content. AI output can be inaccurate, incomplete or unsuitable for a given situation. You are responsible for configuring, reviewing and supervising the agents you deploy, and for the content they send on your behalf. Do not rely on AI output for legal, financial, medical or other professional advice.

9. Availability and support

We aim to keep the platform available and reliable, but we do not guarantee uninterrupted service. The platform may be unavailable during planned maintenance, or because of faults, third-party outages or events beyond our reasonable control. We will give reasonable notice of planned maintenance where practicable.

10. Intellectual property

All rights, title and interest in the platform, the website, the Autozap name and logo, and all related software and documentation remain with Autozap and its licensors. Nothing in these Terms transfers any of those rights to you.

WhatsApp, Meta, Facebook and Instagram are trademarks of Meta Platforms, Inc. Autozap is an independent business and is not endorsed by, affiliated with or sponsored by Meta.

Google, Blogger, Google Business Profile and Search Console are trademarks of Google LLC. Autozap is an independent business and is not endorsed by, affiliated with or sponsored by Google.

11. Suspension and termination

• You may cancel your subscription at any time from your account settings or by emailing us. Access continues to the end of the paid billing period.
• We may suspend or terminate your account if you materially breach these Terms, fail to pay, or use the platform in a way that creates legal or security risk. Where practical we will give notice and a chance to fix the problem first.
• On termination, your licence ends. You may request an export of your Customer Data within 90 days, after which it is deleted as described in our Privacy Policy.

12. Disclaimers

Except as expressly stated in these Terms and to the fullest extent permitted by law, the platform is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

We make no guarantee about business results, revenue, lead volume or conversion rates. Any figures shown in marketing material are illustrative, not a promise of outcome.

13. Limitation of liability

To the fullest extent permitted by law:

• Autozap is not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data, goodwill or business opportunity.
• Our total aggregate liability arising out of or relating to these Terms or the platform is limited to the fees you actually paid to us in the three months immediately before the event giving rise to the claim.

Nothing in these Terms excludes liability that cannot lawfully be excluded.

14. Indemnity

You agree to indemnify and hold Autozap harmless against claims, damages, losses and reasonable costs arising from your Customer Data, your use of the platform in breach of these Terms, or your breach of any applicable law or third-party policy, including Meta's.

15. Changes to these Terms

We may update these Terms. The effective date above shows when they were last revised. For material changes we will notify you by email or through the platform at least 15 days before they take effect. Continuing to use the platform after that date means you accept the revised Terms.

16. Governing law and disputes

These Terms are governed by the laws of India. The courts at Pune, Maharashtra have exclusive jurisdiction over any dispute arising from them. Before starting proceedings, both parties agree to attempt in good faith to resolve the dispute by discussion, beginning with written notice to the other party.

17. General

• If any provision is found unenforceable, the rest remains in force.
• Our failure to enforce a provision is not a waiver of it.
• You may not assign these Terms without our written consent. We may assign them as part of a merger, acquisition or sale of the business.
• These Terms, together with the Privacy Policy and Refund Policy, are the entire agreement between us regarding the platform.
